Agreement:
This Stallion Service Contract for the breeding season of 2008 is made and entered into on this _____day of ____________, is by and between Mountain Meadows Equestrian Center , hereinafter designated Breeder, and ________________________________, herein after designated Mare Owner. Mare Owner agrees to breed the mare ________________________________ Reg. No.___________ to the stallion, Western Sun, using transported cooled semen, for the non-refundable breeding fee of $1500.00.
This service is subject to the following terms and conditions:
1. The Stallion breeding fee of $1500.00 and is due in its entirety before the first breeding and is payable to Mountain Meadows Equestrian Center. A non-refundable booking fee of $350.00 is due with the return of this contract and is applicable to the stud fee.
2. The mare owner, and his/her license veterinarian, have the responsibility to ascertain that the mare to be is in sound breeding condition and free of infection.
3. The Stallion breeding fee does not include collection or shipments for the breeding season of 2008. Any shipments will have a distribution fee from Ron Thompson DVM, 17 Chenoweth Drive, Bridgeport, WV (phone number 304 842 4836). Mare owner agrees to pay a collection/processing/shipping charge of $300.00 for each shipment of semen requested. All shipments will be done in accordance to Ron Thompson DVM, 17 Chenoweth Drive, Bridgeport, WV (phone number 304 842 4836) Equine Facility’s shipping policies.
4. The breeder assumes responsibility only to deliver semen in a viable condition at the time of delivery to the mare owner’s farm or other designated location. Breeder makes no representation or warranties, expressed or implied, regarding the delivery of the cooled transported semen delivered under this agreement, and shall not be responsible for delayed, lost or mishandled deliveries.
5. The semen must be administered by or under the supervision of a license veterinarian and paper work duly signed. If semen arrives in an unsatisfactory condition, Mare Owner’s veterinarian must notify Ron Thompson DVM, 17 Chenoweth Drive, Bridgeport, WV 304 842 4836 immediately.
6. Mare Owner/Lessee must confirm status of pregnancy (pregnant or open) of mare at 45 days with a letter of certificate from mare‘s attending veterinarian to Mountain Meadows Equestrian Center.
7. The Mare Owner understands the breeder reserves the right to refuse any contract for breeding at its own discretion.
8. Breeding season begins February 15, 2008 and ends July 1, 2008.
9. A photo static copy of mare’s registration papers must accompany the signed contract. The owner on the registration papers at the time of breeding will be the recorded owner on the Stallion Breeding Report.
10. The parties agree the Mare Owner shall assume all responsibility for the condition of the mare and shall bear all risk of loss or damage to the mare whether by death, disease, injury, infection, or otherwise, and by any cause whatsoever, and therefore agree to hold the Breeder or any person employed by or associates with the Breeder, harmless for any and all damages associated therewith.
11. The stallion owner or any of their representatives shall not be liable to the Mare Owner/Lessee or any other person for the failure of the mare to produce a live foal for any reason whatsoever.
12. Mare Owner agrees to comply with all requirements, as applicable concerning the use and handling of cooled transported semen.
13. In the event that Western Sun dies or becomes unfit for service, the breeding fee will be refunded to Mare Owner and the parties to this contract will be released from any further rights, obligations or liabilities hereafter. If the Mare dies or becomes unfit for breeding, the Mare Owner may substitute with another Mare.
14. LIVE FOAL GUARANTEE: Live foal is described as a newborn foal that stands and nurse for the first 72 hours. If mare proves barren, aborts or if the foal is stillborn, a return season will be guaranteed the following year only with written certification by a licensed veterinarian within 10 days of examination. Appropriate shipping/chute fees will apply on rebreeds.
15. A breeder’s certificate will be issued to the Mare Owner after all fees have been paid in full and upon notification of birth of foal.
16. This contract is entered into in Marion County, West Virginia and shall be governed by the laws of the State of West Virginia. The parties agree that jurisdiction and venue for any dispute arising under this contract shall be in Marion County, West Virginia.
This contract signed by Mare Owner and Breeder and accompanied by breeding and or booking fee shall be a binding contract on both parties on the above terms and conditions. This contract constitutes the entire agreement between the parties concerning the breeding of the Mare and the Stallion and supersedes all other agreements or understandings between the parties whether oral or written concerning the breeding of the said Mare and Stallion. Upon return of completed contract, Breeder will forward breeding schedule and ordering instructions.
